California Privacy Information

Effective Date: 12/10/2025

This California Consumer Privacy Notice supplements the information provided in the Atlantic Avenue Mortgage, LLC (“Company” or “we” or “us” or “our”) Privacy Policy and applies exclusively to residents of the State of California. This Notice is provided in accordance with the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”).

Categories of Personal Information We Collect

Over the past twelve months, we may have collected a wide range of Personal Information about California residents in connection with the mortgage services we provide. This includes basic identifying details such as your name, address, email, phone number, and other contact information, as well as government-issued identifiers such as your Social Security Number, driver’s license, or other similar information required for mortgage transactions. We may also collect customer records defined under California Civil Code §1798.80(e), which include financial information, employment details, property-related data, insurance information, and other documents that help us evaluate your eligibility for mortgage products.

Certain federal regulations require us to gather limited demographic details such as race, ethnicity, sex, and age for reporting and compliance purposes, especially for Home Mortgage Disclosure Act (HMDA) requirements; however, we do not use this information for marketing or decision-making. Additionally, when you interact with our website, we may collect digital information such as your IP address, browsing activity, search queries, device information, and other analytics-derived data. We may also collect geolocation data based on your IP address, along with professional or employment information submitted as part of a loan application. In some cases, we may draw inferences from the data we collect to better understand your needs or determine your potential interest in certain services. Although some of this information may be considered “sensitive” under the CPRA, we handle it only in ways permitted by law and only for purposes necessary to provide you with financial services or comply with regulatory requirements.

Sources of Personal Information

We collect Personal Information from multiple sources, each of which plays an important role in supporting the mortgage process. Most commonly, we receive information directly from you when you complete online forms, submit a loan application, upload documents, respond to our communications, request information, or otherwise interact with our team. We also collect data automatically through your interactions with our website using tools such as cookies, pixels, analytics platforms, and other technologies that provide insight into how visitors navigate and use our online services. Beyond these direct and automated sources, we may also receive information from third parties who help support our operations, including credit bureaus, verification services, public record databases, referral partners, advertising platforms, real estate professionals, and companies involved in the mortgage process such as appraisal firms, title companies, and insurance providers. These third-party sources help us validate information, assess eligibility, maintain regulatory compliance, and offer you the most accurate and streamlined experience possible.

Purposes for Collecting and Using Personal Information

We use Personal Information for a variety of business and operational purposes that are essential to delivering mortgage services and meeting legal requirements. This includes processing loan applications, verifying your identity, confirming financial details, evaluating eligibility for mortgage products, and facilitating communication throughout the mortgage process. We also use your information to detect and prevent fraud, enhance security, and comply with laws such as the Gramm-Leach-Bliley Act, Anti-Money Laundering regulations, the Home Mortgage Disclosure Act, and other federal and state requirements that apply to financial institutions and mortgage brokers.

In addition to these core uses, we analyze website interactions to improve system performance, optimize user experience, correct errors, and ensure our digital services function properly. We may also use Personal Information to respond to your inquiries, maintain customer relationships, and provide general information about our services or updates relevant to your inquiries or ongoing transactions. Occasionally, we may use information for marketing or outreach where permitted by law, but such communications are always optional and can be discontinued at any time. Importantly, we do not use collected Personal Information for automated decision-making that produces legal or significant effects, nor do we use sensitive Personal Information for any purpose beyond those strictly allowed by the CPRA.

How Personal Information Is Shared or Disclosed

We may disclose Personal Information to third parties when it is necessary to complete your mortgage-related transactions, operate our business, or comply with legal obligations. For example, we may share information with service providers who perform essential operational functions on our behalf, including technology vendors, document processors, verification services, customer support platforms, analytics providers, and secure cloud-hosting companies. When required to evaluate or process a mortgage application, we may also share information with lenders, title companies, appraisal companies, insurance carriers, and other participants in the loan transaction.

In some cases, we may be required to share information with regulatory agencies, government bodies, auditors, or legal counsel to comply with applicable laws, respond to subpoenas, meet reporting obligations, or address legal matters. If Atlantic Avenue Mortgage undergoes a merger, acquisition, corporate restructuring, or sale of assets, your information may be transferred to successor entities, subject to appropriate protections. We may also share limited information with social media or online advertising platforms for operational purposes that do not constitute selling or sharing under the CPRA. We do not sell Personal Information, and we do not share Personal Information for cross-context behavioral advertising. Any information shared is done so under strict conditions, and only to the extent necessary to support our services or meet legal and regulatory standards.

Your Rights Under the CCPA/CPRA

As a California resident, you are granted several important rights related to your Personal Information. You have the right to know what categories and specific pieces of Personal Information we have collected about you, the right to access that information, and the right to request details about the sources of the information, the purposes for which it was collected, and the categories of third parties with whom it is shared. You also have the right to request the deletion of Personal Information we maintain about you, although certain legal and operational exceptions apply, particularly due to strict mortgage-industry regulations requiring the retention of financial and transactional records. If your Personal Information is inaccurate, you have the right to request correction, and we will take reasonable steps to update or rectify any confirmed inaccuracies.

California residents also have the right to limit how their sensitive Personal Information is used, but because Atlantic Avenue Mortgage does not use sensitive Personal Information for any purpose requiring an opt-out under the CPRA, this right is satisfied by default. You also have the right to opt out of the sale or sharing of Personal Information; however, because we do not sell or share Personal Information as defined by the CPRA, this right is already honored without requiring further action. Additionally, the law gives you the right not to be discriminated against for exercising any of your privacy rights, meaning we will not deny services, charge different prices, offer a different level of service, or retaliate in any way if you choose to submit a privacy-related request.

How to Submit a Privacy Request

If you wish to exercise any of your rights under the CCPA/CPRA, you may contact us by email, phone, or mail using the contact information provided below. When you submit a request, we may need to verify your identity to ensure that your Personal Information is not disclosed to or altered by unauthorized parties. This verification may require you to provide certain details or documentation that confirm your identity. You may also designate an authorized agent to make a request on your behalf, provided the agent can demonstrate valid authorization and we are able to verify both your identity and the agent’s authority. Once your request is verified, we will respond in accordance with California law, usually within 45 days, although additional time may be required in certain circumstances.

Retention of Personal Information

We retain Personal Information for the length of time necessary to fulfill the purposes for which it was collected, which may vary depending on the nature of the information and the type of services being provided. Because mortgage transactions are regulated by federal and state laws that impose strict recordkeeping obligations, we may retain your information for several years to comply with audit, reporting, legal, and operational requirements. We also retain information as needed to prevent fraud, resolve disputes, enforce contracts, maintain business operations, or address issues related to regulatory compliance. When Personal Information is no longer required, we follow commercially reasonable procedures to securely dispose of or anonymize it in accordance with applicable laws and internal data-retention policies.

Changes to This Notice

We may update this California Consumer Privacy Notice from time to time to reflect changes in legal requirements, industry standards, or our business practices. When updates occur, we will revise the effective date at the top of this Notice. We encourage you to review this page periodically so you remain informed about how we collect, use, and protect your Personal Information as a California resident. Continued use of our website or services after changes are posted constitutes acknowledgment and acceptance of the updated Notice.
